1. Agreement to Terms
By accessing or using Tradejoy, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. You must be at least 18 years of age to use Tradejoy.
These Terms apply to users in the United Kingdom only. If you are accessing our services from outside the UK, please contact us for applicable terms.
2. Description of Service
Tradejoy is a technology platform that helps property maintenance companies manage operations: enquiries, quotes, scheduling, customer updates, payments, trader coordination, job records, documents, and certificates.
Tradejoy does not provide trade services and is not an electrical, plumbing, gas, or property maintenance contractor. Work is carried out by the company, its employees, contractors, traders, or other service providers responsible for that job.
When a customer approves work through a company job page, the contract for the maintenance work is between the customer and the relevant company or service provider, not with Tradejoy.
3. Company and Trader Responsibility
Companies and traders using Tradejoy are responsible for holding the qualifications, accreditations, insurance, registrations, and permissions required for the work they carry out.
4. Payments and Fees
Payments are processed securely through the company organisation's Stripe account. When you accept a quote, payment timing follows the company's customer-type rules. Some jobs require upfront payment before dispatch; others may be invoiced after completion.
The total price shown to you includes all customer-facing charges for the quoted work. Individual trader team members do not connect Stripe accounts or receive platform payouts directly through Tradejoy.
5. Cancellations, Refunds, and Payments
Payment Timing
Payment timing depends on the company's customer-type rules. Some jobs require upfront payment before dispatch. Other jobs may be invoiced after completion. The customer-facing amount is shown as one total before you approve the next step.
Payments are processed through the company organisation's Stripe account. Individual trader team members do not connect Stripe accounts or receive platform payouts directly through Tradejoy.
Cancellation by Customer
You may cancel a job booking through the app. Refund eligibility depends on timing:
- Before assignment: No cancellation charge unless the company terms state otherwise
- After assignment but before travel: Cancellation should be made as soon as possible; refund eligibility depends on the company's terms
- After a trader has commenced travel or arrived: You may be charged a cancellation fee under the company's policy to compensate for time and travel costs
- After work has commenced: You will be charged for work completed up to the point of cancellation, as agreed with the company
Cancellation by Company or Trader
If the company or assigned trader cancels after assignment, the company will update the job and any payment or refund handling will follow the company payment policy and applicable consumer law.
Disputed Work or Dissatisfaction
If you are unsatisfied with work performed or there is a dispute about completion, contact us immediately through the job page or company support channel. We will work with you and the company to investigate and resolve the issue.
Refund eligibility depends on the job record, company policy, payment state, applicable law, and investigation of your claim.
Non-Refundable Fees
Any non-refundable fees are assessed according to the company payment terms, the job record, and applicable law once a company trader has been assigned or work has commenced.
6. User Conduct
You agree not to:
- Provide false or misleading information
- Use the platform for any illegal purpose
- Harass, abuse, or harm other users, companies, traders, or customers
- Attempt to circumvent our payment system
- Interfere with the proper functioning of the platform
7. No Warranty and "As Is" Provision
The Tradejoy platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Tradejoy makes no representations, warranties, or guarantees regarding:
- The quality, safety, suitability, or legality of services provided by companies or traders
- The qualifications, background, or conduct of companies, traders, or other service providers
- The ability of companies or traders to provide services
- That the platform will be uninterrupted, secure, or error-free
You acknowledge that you may be introduced to third parties who may pose harm or risk to you or your property, and you should take reasonable precautions in all interactions.
8. Limitation of Liability
Tradejoy and its affiliates disclaim all liability for any act or omission of companies, traders, users, or other third parties.
To the maximum extent permitted by law, Tradejoy shall not be liable for:
- Any injury, loss, claim, damage, or any special, exemplary, punitive, incidental, indirect, or consequential damages of any kind arising from maintenance services
- Damages resulting from the acts or omissions of companies, traders, or other service providers
- Property damage, personal injury, or death caused by companies, traders, or other service providers
- Disputes between users, customers, companies, traders, or other service providers
- Any failure, delay, or interruption of the platform
- Loss of profits, revenue, data, or business opportunities
Where we may be held liable, our total liability shall not exceed the amount of processing fees you actually paid to Tradejoy in the six months preceding the claim, or £100, whichever is lower.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Tradejoy, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the platform
- Your breach of these Terms
- Your interaction with any company, trader, customer, or service provider
- Services provided by companies, traders, or other service providers using our platform
- Your violation of any rights of another person or entity
10. Dispute Resolution
If you have a dispute with a company, trader, customer, or other service provider, that dispute is between the relevant parties, not with Tradejoy. While we may offer to facilitate communication, we have no obligation to resolve disputes and disclaim any liability related to such disputes.
For disputes with Tradejoy regarding the platform itself, please contact us through the app. We will attempt to resolve complaints informally. If we cannot resolve a complaint through informal discussions, you may pursue your legal rights through the courts of England and Wales.
11. Changes to Terms
We may modify these terms at any time by posting updated terms on our platform. Material changes will be notified through the app or by email. Continued use of Tradejoy after changes are posted constitutes acceptance of the modified terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of Tradejoy shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Company Organisations and Team Members
Tradejoy accounts for trade delivery are held by company organisations. Individual traders are company team members invited by their organisation.
Company organisations that use the Tradejoy platform:
- Own company pricing: Company admins manage services, rates, and quotes. Individual trader team members do not set prices or connect Stripe accounts through Tradejoy.
- Manage team schedules: Company admins configure team members, service assignments, working hours, and job routing.
- Provide operational resources: The company is responsible for tools, equipment, vehicles, insurance, materials, staff, and subcontractor arrangements required to perform services.
- Operate independently: Companies can offer services through other platforms or directly to customers and maintain their own client relationships.
- Control how work is performed: Companies and their authorised team members determine the methods, techniques, and procedures used to complete maintenance work, subject to applicable building regulations and safety standards.
- Bear business risk: Companies are responsible for their own business expenses, taxes, insurance, staff arrangements, and any losses or damages arising from their work.
Tradejoy does not supervise, direct, control, or monitor how companies or traders perform their work. We provide a technology platform to help company organisations manage operations, communications, job records, payments, and documents.
